Who is required to be included in the Ownership Interest and/or Managing Control Information (Individuals) Section?


Answer:
The following individuals are required to be listed in the Ownership Interest and/or Managing Control Information (Individuals) section:

  • All individuals with a five percent or greater ownership. There must be at least ONE organizational or individual owner listed for each application. If an organizational owner, the entity would be listed in the Ownership Interest and/or Managing Control Information (Organizations) section.
  • If the supplier is a corporation, all officers and members of the board of directors (including non-profit governing body)
  • All partners must be included, even those individuals with less than five percent partnership interest. If an individual is a partner with a corporation, the corporation must be listed as a partner in the Ownership Interest and/or Managing Control Information (Organizations) section and the individual must be listed as a partner in the Ownership Interest and/or Managing Control Information (Individuals) section.
  • All managing employees are required to be listed for each location. Managing employees are general managers, business managers, administrators, directors, or other individuals exercise operational or managerial control, or directly or indirectly conduct day-to-day operations, either under contract or through some other arrangement, whether or not the individual is a W–2 employee of the provider or supplier (e.g. Chief Executive Officer, Chief Operating Officer, Chief Financial Officer, Regional Officer, Administration Manager, Compliance Director, etc.) 
  • Authorized and delegated officials listed in the Authorized Official Certification Statement and Signature section and the Assignment of Delegated Official(s) section must also be included. There must be at least ONE authorized official listed for each application. Delegated officials are optional.
  • Any managing organization which exercises operational management control over or conducts the day-to-day operations of the supplier. These organizations may included, but are not limited to financial institutions, holding companies, trusts, management services companies, non-profit entities, etc.
